PREAMBLE

The provisions of the document below define the general conditions of sale (CGV) attributable to sales concluded between natural persons who purchase on the website https://www.monbarth.com, hereinafter referred to as “the customer” and the site www.monbarth.com, Monbarth SAS company whose head office is located at Villa créole lot 18 – St jean 97133 St Barthelemy and registered with the RCS Basse Terre TMC 840941769.

OBJECT

The purpose of these general conditions of sale is the sale of different products and accessories online from the Monbarth site on the Internet and the relationships establishing the reciprocal rights and obligations of the parties as well as the different stages of the order process. The sale is reserved for adults or minors with parental authorization.

PRODUCTS AND ORDERS

The products offered for sale by Monbarth are those which appear on the site while stocks last. If the product is not available, Monbarth undertakes to inform the customer as quickly as possible.

The products offered for sale are described and presented with the greatest possible accuracy.

Any order constitutes acceptance of the prices and description of the products available for sale. Monbarth undertakes to honor orders received on the website only within the limits of available product stocks.

Monbarth reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any risk in its eyes.

All orders require filling out a form containing the following information: title, surname, first name, date of birth, full delivery address, e-mail and telephone number.

As soon as an order is validated regardless of the payment method chosen by the customer, Monbarth will acknowledge receipt of the order by email or by any other means at its convenience, in accordance with the provisions of article L121-19 of the code of the consumption.

PRICE

All product prices are indicated in euros, all taxes included, excluding shipping costs (see “Delivery and Shipping” paragraph).

The shipping costs which will be invoiced in addition will be specified to the customer upon final validation of their order.

Monbarth reserves the right to modify its prices at any time without notice.

The products will be invoiced on the basis of the prices in force at the time of order registration. The products remain the property of Monbarth until full payment of the price by Monbarth. The price is payable in full and in a single payment.

DELIVERIES AND SHIPMENTS

Excluding sales periods and end-of-year holidays (where heavy traffic of requests may cause additional delivery time), any order placed on the Monbarth site from Monday to Friday (excluding public holidays) will be prepared and shipped within 48 hours provided that the product is in stock and subject to validation of payment (see following paragraph “Payment”). The customer will be delivered by Post “Colissimo” or by DPD.

Products ordered on the monbarth.com website are deliverable throughout the Europe zone.

Delivery delay :

Delivery within 10 days in mainland France (deadline in working days).

Delivery within 21 days for all other countries in the Europe zone (deadline in working days).

The products are shipped with the delivery note, to the delivery address indicated by the customer when ordering.

The deadlines have no contractual value, they correspond to the average usual deadlines on the site and take into consideration the order processing time as well as delivery.

Delivery prices are as follows:

For France: €10 including tax – Free shipping for orders over €200 including tax.

Outside France: €15 including tax (single rate) – Free shipping for orders over €200 including tax.

Upon receipt of his order, the customer will ensure to check the conformity of the products received. Any anomaly concerning delivery (missing product or damaged package) must be notified, on the same day of receipt or at the latest 3 days following receipt, to the Monbarth head office, by registered mail (name and address: see “Preamble” ).

Any claim made after this deadline will be rejected and Monbarth will be released from all liability. Monbarth reserves the right to ask the customer to return the defective product.

If the aforementioned conditions are met, Monbarth will then exchange, issue a credit, reimburse the defective product(s), or reship the missing product (subject to the validity of the buyer's request).

Products for sale on the monbarth.com website can be delivered to the Europe zone. .Monbarth reserves the right to modify the list of deliverable countries at any time.

DAMAGED PACKAGES

The customer must not receive a damaged package (packaging showing visible traces of opening and/or deterioration): it must be refused. Indeed, packages leaving the warehouses of the monbarth.com site are always impeccable, and must be delivered to the customer in this condition. If no reservations have been made upon receipt of the goods, we will not be able to take into account possible disappearances or provide compensation.

DELIVERIES

The package is delivered to the delivery address indicated on the order form. It is therefore important to be precise about your delivery address. Delivery takes place from Monday to Friday.

In the event of absence, the delivery person leaves a calling card, indicating the conditions for collecting the package (location and deadlines). Processing times are generally 15 days.

Deadlines: the package leaves our premises the same day if the order was placed before 12 p.m. and confirmed. For orders placed on Friday after 12 p.m., the package will be shipped the following Monday.

 PAYMENT

The amount owed by the customer is the amount indicated on the order confirmation sent by e-mail by Monbarth to the customer. Payment will be made, unless the server is unavailable, immediately on the Internet by credit card (Blue, Visa, Eurocard/Mastercard) or by Paypal.

In any event, Monbarth reserves the right to refuse any order or delivery in the event of an existing dispute with the customer, total or partial non-payment of a previous order by the customer, refusal of payment authorization by bank card from banking organizations, non-payment or partial payment. Monbarth cannot be held liable under any circumstances in this respect.

For any amount greater than 120 euros, in accordance with article L.134-2 of the Consumer Code, Monbarth will archive proof of the written execution of the sale on paper or electronic media during the applicable legal deadlines. The customer has access to this document at any time, upon request made to Monbarth by attaching proof of his identity.

Payment for purchases is made at the customer's choice:

– by bank card: Visa, MasterCard, Carte Bleue issued in Europe

– by PayPal

EXCHANGE, RETURN and REFUND

The customer has a legal period of 14 clear days to exercise his right of withdrawal from the date of receipt of the goods.
The returned product(s) must be new, unused and in their original box perfectly intact. Any exchange or return must be the subject of an exchange or return request to Monbarth from Monday to Friday by e-mail to the following address: contact@monbarth.com .
Shipping costs for returning products by post (Colissimo) or by carrier are the exclusive responsibility of the customer.

If he has chosen to send us his return package by Colissimo, his exchange order will be dispatched within 48 hours following the return of the returned items to stock.

If the amount of the customer's exchange order is greater than the amount of their initial order, they can pay the difference online by credit card or PayPal. Shipping of the customer's exchange order is conditional on validation of this payment.

If the amount of the customer's exchange order is less than the amount of the initial order, Monbarth will reimburse him the difference within 15 days following receipt of his return package to our warehouse if he returned his package to us via Colissimo.

The customer must keep proof of delivery of the package which will be given to them by the delivery person. In the event of loss of the package, no refund will be made without this proof of deposit.

CONDITION OF PRODUCTS

All returned products (product, original packaging, accessories, instructions, etc.) must be returned perfectly intact. Upon receipt of the package, Monbarth will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned products have been visibly used or damaged by the customer and this use or damage renders the products unfit for sale.

If the return is refused by Monbarth, the products will then be returned to the customer at Monbarth's expense without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the goods. sold.

In the case of an exchange, if the returned products have been visibly used or damaged by the customer and this use or damage renders them unfit for sale, Monbarth may take any corresponding recovery action from the customer.

 REFUNDS and RETURNS

Subject to compliance with these return conditions, Monbarth will reimburse the products returned within 15 days following the return of the goods to stock, after deduction of shipping costs if they were invoiced during the initial order (orders of an amount less than €100 not benefiting from free shipping).

Pimentdemer.fr offers temporary reductions via “promo codes”. These codes are offered under certain conditions with minimum purchases. These reductions constitute gifts and Monbarth reserves the right to pass them on to its customers or not.
